On May 3, 2017, U.S. Citizenship & Immigration Services (USCIS) announced it had completed data entry of all fiscal year 2018 H-1B cap-subject petitions. The returning of all H-1B cap-subject petitions that were not selected will now begin. USCIS has stated that “due to the higher volume of filings USCIS is unable to provide a definite time for returning these petitions.” Additionally, petitioners are asked to not make inquiries into the status of their submitted petitions until receipt notices or unselected petitions have been returned.
In order to expedite adjudication of H-1B filing, USCIS will be transferring some Form I-129 H-1B cap subject petitions from the Vermont Service Center, to the California Service Center to balance the distribution of selected cap cases.
As a reminder, USCIS announced back in March 3, that premium processing for all H-1B petitions, including cap-subject petitions, would be suspended for up to six months. While this suspension is in place, petitioners will not be able to file Form I-907, Request for Premium Processing Service, for an I-129, Petition for a Nonimmigrant Worker, for H-1B nonimmigrant petitions. Therefore, any Form I-907 filed with an H-1B will be rejected until USCIS reinstates the premium processing service.
